1. General
The following are terms and conditions of a legal agreement between you and Zeutek. These terms and conditions, in conjunction with our Privacy Policy, govern your use of this website and the services, features and content offered by Zeutek. In using this website, you acknowledge you have read, understood and agree to comply with and be bound by these terms and conditions.
2. Cookies
This website uses cookies. By accessing Zeutek, you consent to our use of cookies in accordance with the terms of our Privacy Policy.
3. Account Terms
3.1 By using this site, you represent and warrant that you are at least 18 years old. Where you are under the age of 18, you may only use this website with the consent of your parent or guardian.
3.2 You represent and warrant that all information you submit to Zeutek is current, accurate, and truthful and does not infringe or violate any rights of third parties. In using this website you agree to keep your Account Information updated and agree to notify us immediately of any change in your eligibility to use the services. You agree that you are solely liable for all activities that occur on your Account and for any loss or damage from your failure to maintain the security of your Account Information.
3.3 You warrant that you will not use this website, its services and its information in any way that:
- causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or
- in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
3.4 You warrant and agree that you will not use this website to copy, store, host, transmit, send, use, launch, publish or distribute any material which consists of, or is connected to, any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
3.5 You warrant and agree that you will not use this website to conduct any automated means or process, including but not limited to scraping, data mining, data extraction and data harvesting.
3.6 We reserve the right to suspend, prohibit or refuse service to or terminate the service of anyone at any time without notice for any reason.
4. License
4.1 Unless otherwise stated, Zeutek and/or its licensors own the intellectual property rights in the website and all content supplied on the website. Subject to the license below, all intellectual property rights are reserved by Zeutek or its licensors.
4.2 Subject to the restrictions detailed in this agreement, you may view, download and print the content supplied by Zeutek solely for your own personal use.
4.3 You must not without written consent from Zeutek:
- Republish material from this website (including republication on another website);
- Sell, rent or sub-license material from the website;
- Show any material from the website in public;
- Modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any content from the website;
- Reproduce, duplicate, copy or otherwise exploit material on the website for a commercial purpose; or
- Redistribute material from the website except for content specifically and expressly made available for redistribution
5. Ordering Process –3D Printed model (you supply the digital design – we print)
5.1 To request a quote for a 3D Printed Model (“3D model”) from Zeutek you must upload to the Zeutek 3D printing tool a clear and unambiguous digital model design for the model you would like to produce. The file and information that you supply to Zeutek must comply with the form and requirements as from time to time specified by Zeutek. You must also select the material, colour, layer resolution, scale, infill, quantity and size of the model, and whether you would like Zeutek to remove the model’s supports.
5.2 Once you have placed your request in accordance with clause 5.1, Zeutek will provide to you an initial instant automated estimated (“automatic quote”) for the cost of the 3D model. Provision by Zeutek to you of an automatic quote for your order is not an acceptance by Zeutek of your order.
5.3 If you wish to proceed with your order then you must:
5.3.1 provide through an online form all other information required by Zeutek, including your email address, and your preferred delivery option; and
5.3.2 authorise payment via PayPal to Zeutek of the full amount of the automated quote. However, such authorisation does not, at this stage, create a binding obligation on Zeutek to manufacture your order.
5.4 Prior to accepting your order and commencing production of the 3D model, Zeutek will manually review the order and automatic quote, after which:
- 5.4.1 if there is no increase in the automated quote, Zeutek will accept the payment of funds through paypal, which is an acceptance by Zeutek of your order for the 3D model at the automatic quote price. Zeutek will then begin production of the 3D model. However;
- 5.4.2 if Zeutek wishes to increase the price for production of the 3D model from that provided in the automatic quote, it will send to you by email a revised quote for the 3D model. Should you wish to proceed with the order on the basis of this revised quote you must then authorize payment through paypal of these additional costs of producing the model as outlined in this revised quote. Once Zeutek accepts payment through paypal of the full amount the revised quote, this is acceptance by Zeutek of your order for the 3D model at the revised quote price. Zeutek will then begin production of the 3D model.
5.5 Once Zeutek accepts payment through PayPal of the automatic quote or the revised quote (as the case may be), from this point on the order cannot be cancelled, and you will be obliged to pay for the full cost of the order.
6. Ordering Process – 3D Modelling and Printing Service (we produce the digital design then print)
6.1 To request a quote for a 3D model from Zeutek when you don’t have a digital design of that model, you must upload through Zeutek’s web site clear and unambiguous sketches for the model you would like Zeutek produce, and select the material, colour, layer resolution, scale, infill, quantity and size of the model, and whether they would like Zeutek to remove the model’s supports. You must also provide all other information required by Zeutek including your email, delivery details etc.
6.2 Zeutek will, normally within 24 hours, provide to you by email a quote for the work to be undertaken by Zeutek. That work will include preparation of a digital 3D design for the item to be 3D printed, and the production of the 3D printed model. That quote will also contain a link to payment for the order via paypal.
6.3 If you wish to proceed with the order on the basis of that quote, you must then make payment for the order through PayPal.
6.4 After you have made payment through PayPal, Zeutek will provide to you a digital model for the item to be printed, for you to confirm that that model is correct, or to request changes to that model.
6.5 If you require changes to the model through no fault of Zeutek (including, for example, due to ambiguities in the initial sketch or information that you provided), additional charges will be payable by you for such changes. You will need to make payment of all such additional charges via paypal to Zeutek before Zeutek will start production of your order.
6.6 Once you make all payments for the finalised design through paypal, and confirm you are happy with the digital design, or the amended final digital design (as the case may be), you have placed your order. From this point on the order cannot be cancelled, and you will be obliged to pay for the full cost of the order.
6.7 You acknowledge and accept that the 3D model that you have ordered will be produced in accordance with the final digital design provided to you by Zeutek and accepted by you, and you accept any peculiarities, weaknesses or faults apparent or inherent in that design. Further, you acknowledge that you will have no right to make any complaint or claim against Zeutek about size, shape, dimensions, or any other aspect of the 3D printed model supplied to you if produced in accordance with that final design.
7. Notes on the ordering process
7.1 Cancellation of orders by us. If you receive a confirmation email from us, the default assumption is that your order can be produced. However, there are technical reasons why Zeutek may not accept your order or why Zeutek may cancel your order. In the case we cancel your partial or entire order, we will contact you via email and reimburse all monies paid, or part monies paid if the order is partially fulfilled.
7.2 Prices. The price quoted upon placement of the order is calculated through an automated service. Due to technical reasons, the automated quote may not always be correct and Zeutek reserves the right to revoke and/or cancel any order, and to amend the cost of the order. If the cost is increased, you may choose not to proceed with the order, and in those circumstances all monies paid by you will be refunded.
7.3 Changes to your order. Due to the personalised nature of the 3D printing service and model production, you cannot cancel your order after it goes into design or production. So please ensure that all information submitted in your order is accurate and complete before order confirmation. Should you wish to make any changes to your order, you must notify Zeutek immediately. However, you acknowledge that Zeutek cannot modify any orders once they have gone into production. Where Zeutek does consent to any modifications, you will be notified via email, and in such circumstances, you accept that you may incur an additional fee.
8. Nature of Goods produced by Zeutek
8.1 You accept that all 3D items manufactured and supplied by Zeutek are suitable for decorative purposes only. Such items do not have any utilitarian, functional or structural purpose and we do not represent or warrant that these items are fit for any purpose other than display.
8.2 Any 3D items manufactured by Zeutek are not suitable to be used as toys, or to be given to children. Any 3D items manufactured by Zeutek should not come in contact with electricity, food or liquids and should be kept away from heat sources.
8.3 Due to technical reasons outside of our control, on occasion your choice of shape/size/material/surface/colour/resolution etc. may create some finishing irregularities in the 3D model/item. Such irregularities may also result from colour quality of photographs, the difficulty showing the texture of a material on screen or, without limitation, technical adaption. When placing your order you accept that such irregularities might occur, and agree that such irregularities, providing they are minor, do not constitute a defect in the goods manufactured, and do not entitle you to any refund or compensation, or to a right to cancel the order.
8.4 The longevity of any 3D printed item produced by Zeutek for you depends on a number of factors, including the design, the material used, where the item is stored or displayed, and how and by whom the items is handled. Zeutek makes no warranty as to the expected life span of the item, and nor does it warrant that the item will not deteriorate over time with exposure to the elements, and/or heat and/or direct sunlight.
9. Content Policy violations
You expressly certify that any 3D Model design uploaded to Zeutek does not violate any Australian laws, rules and regulations or any international laws, rules and regulations applicable to you, including those pertaining to firearms, their components, or any other prototype or model intended for the weapon industry.
10. Payment
10.1 Unless otherwise indicated, all prices are in Australian dollars – AUD.
10.2 The price indicated on the order confirmation page includes the cost of the produced and/or supplied goods, the shipping costs and sales taxes and/or any GST payable (which Zeutek is obligated to collect), but excludes any import duty or import taxes (if applicable). You are liable to pay any import duties or taxes, as well as any inbound freight handling costs.
10.3 If you make payment through PayPal.com Zeutek is not responsible for the payment process done via the PayPal.com website. PayPal may charge you additional fees and you should ensure you are familiar with PayPal’s terms of use which you will have agreed to when you set up your PayPal account.
11. Delivery and Risk of Loss
11.1 Zeutek will use its best endeavours to ship the 3D Model to the shipping address, as provided by you, within the delivery time indicated in our confirmation email. However, the actual delivery time is determined by a number of circumstances including but not limited to the reasonable means of the carrier and the distance of the drop off location. Additional time may also be needed over weekends and holiday periods. The shipment date is indicative only, and does not bind Zeutek in any way. Zeutek is not liable for any special, incidental or consequential damages resulting from delivery delays or inability to deliver.
11.2 In the absence of specific written instructions from the buyer, Zeutek will select the common carrier. Zeutek shipping costs do not include customs duties, GST or insurance. The buyer shall be responsible for any such costs.
11.3 Title and risk of loss of damage to the 3D Model order passes to the buyer upon the transfer of the goods from Zeutek to the shipment carrier. Therefore, Zeutek is not liable for any damage to the order once it is collected by the carrier from Zeutek for delivery to you.
11.4 Zeutek strongly recommends that you obtain or have in place insurance to cover you against any loss of damage to the goods during the delivery process.
12. Problems with goods and returns
12.1 As each 3D printed model is manufactured based on your specifications, or in accordance with a digital design we have prepared but you have approved, you cannot cancel your order once it goes into production.
12.2 In the event you believe after receiving your order that the goods have not been manufactured in accordance with your specifications, you must:
- 12.2.1 not use the goods, and
- 12.2.2 notify Zeutek in writing within three business days of delivery of the goods that there is an issue with the goods, and the details of the problem; and
- 12.2.3 at your cost, return the goods in their original packaging to Zeutek as soon as reasonably possible.
12.3 On receipt of the returned goods, Zeutek will assess your claim. In the event that Zeutek accepts your claim, it may, in its discretion, provide a full refund to you, or manufacture and ship to you replacement goods.
12.4 In the event that Zeutek, on reasonable grounds, rejects your claim, you will need to arrange for the goods to be collected from Zeutek and redelivered to you at your cost.
12.5 In the event that you do not notify Zeutek within three business days of delivery of the goods to you (as required by clause 11.2.2), and/or you do not return the goods to Zeutek within a reasonable time (as required by clause 11.2.3), then you accept and acknowledge that you have received from Zeutek all of the goods that you ordered, and that such goods meet your specifications, and Zeutek will have no obligation to compensate you, or any other liability to you, for any goods that you later claim did not meet your specifications.
12.6 If you discover that you are missing items that you have purchased, you must notify Zeutek in writing within three business days of delivery of the goods to you. Failure to do so means that you accept and acknowledge that you have received from Zeutek all of the goods that you ordered, and Zeutek will have no obligation to compensate you, or any other liability to you, for any goods that you later claim were not delivered to you.
13. Intellectual Property Rights
13.1 By uploading your 3D model design to Zeutek, either digitally or by providing sketches or other material to Zeutek, you represent and warrant that you own or have a license to the intellectual property rights to the design and that you have not infringed on any third parties rights or any intellectual property rights by uploading this 3D model design.
13.2 You, as the designer, retain all intellectual property rights to your 3D Model subject to the rights and licenses with respect to your 3D Model that you grant Zeutek.
13.3 Zeutek shall not use, modify or display your 3D Models except subject to the rights and licenses with respect to your 3D Model specified below.
13.4 In uploading your 3D Model to Zeutek, you grant Zeutek a non-exclusive, and sub-licensable right and license to use your 3D Model design for the manufacturing of your 3D Model in order to fulfil your order.
13.5 Where Zeutek produces a digital design for you under clause 6, Zeutek owns and retains all intellectual property, including all copyright, that exists in that digital design, and you may not use or reproduce that digital design without the written consent of Zeutek.
14. Assignment
14.1 When you place an order with Zeutek, you consent to Zeutek transferring, sub-contracting or otherwise dealing with Zeutek’s rights and/or obligations under these terms and conditions without any notice to you.
14.2 You undertake not to transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions without the express written consent of Zeutek.
15. Indemnification
You hereby indemnify Zeutek and each of our employees, contractors, directors, suppliers and representatives from all liabilities, claims and expenses, including but not limited to reasonable legal expenses, that arise from or relate to your use or misuse of, or access to, the services or content provided by Zeutek, or otherwise from your 3D Models or violation of these terms and conditions, or infringement by you of any intellectual property or other rights, claim or action, including but not limited to personal injury or property damage of or to any person or entity.
16. Warranties
16.1 For Australian customers, these terms and conditions are subject to the Australian Consumer Law, and the warranties contained therein.
16.2 All 3D printed models produced by Zeutek are suitable for decorative purposes only, and not for any other purpose.
16.3 Zeutek is not responsible for any damage caused by the use of the 3D model for any other purpose other than decoration, and is not responsible for damage to a 3D printed model caused by normal wear and tear, or damage caused by misuse, moisture, liquids, proximity or exposure to heat and electricity, abuse or neglect.
17. Limitations of Liability
Zeutek will not be liable to you or any third party for any consequential, direct or indirect loss or damage, for any death or personal injury, for any loss of profits, loss of income, loss of contracts, loss of data, damage, and/or compensation for moral harm, costs, losses, lost turnover, or liabilities of any nature which may arise from the use of the website, its contents, or the goods sold to you by Zeutek.
18. Blog
18.1 The information contained on Zeutek’s website is for general information purposes only. Whilst Zeutek endeavours to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
18.2 The content available on Zeutek should not, under any circumstances, be considered legal or professional advice and should not be used to supplement any personal judgement.
